Frequently Asked Questions
Employment Law Wage & Hour Class Action Claims in California
What is a “minimum wage”?
The Fair Labor Standards Act (FLSA) sets forth specific minimum standards for wages for all employees throughout the U.S. Accordingly, employers must pay their employees a certain minimum amount of money. This same act also designates pay for overtime, child labor, equality of pay for male and female employees, and additional related matters. Accordingly, if an employee is being paid less than minimum wage, he or she may be able to seek lost wages by taking legal action against his or her employer.
Does my employer have to pay me for overtime?
Many employees are not eligible to receive overtime as they are paid salaries and are classified as “exempt” which does not allow for overtime pay. People in managerial or administrative positions are generally classified as exempt, but just because you are being paid salary this does not mean that you should automatically be denied overtime pay. If you have questions about this or are unsure of your rights in this regard, please talk to an attorney at the R. Rex Parris Law Firm to learn more about your rights.
What are some unlawful practices related to overtime or wages?
At times, employers may misclassify employees in order to
avoid paying overtime, may have backlogged sales commissions, may delay payment after an employee is terminated or may take other actions that unlawfully deprive employees of the money they have rightfully earned.
How do I know if I have a case?
Whether you have grounds to sue your employer will depend on a number of factors, and it is important that you discuss your unique case with an experienced lawyer to determine whether you can move forward with a claim or lawsuit. Your initial consultation with a California
